Welcome to BoxGames ("BoxGames", "we", "us", "our"), a South African casual gaming and entertainment website. These Terms and Conditions govern your access to and use of the BoxGames website, games and related services (collectively, the "Platform"). By registering, browsing or using the Platform in any way, you confirm that you have read, understood and agree to be fully bound by these Terms together with our Privacy Policy.

1. What BoxGames Is

BoxGames is a casual gaming and entertainment platform. It offers fun, lighthearted games intended for users to enjoy in their spare time. BoxGames does not offer, facilitate or promote real-money betting, gambling, wagering or any regulated gambling product of any kind. All games are purely for casual entertainment purposes and, unless explicitly stated otherwise, do not involve real-money transactions, prize draws or material rewards.

2. Eligibility & Age Limits

  • You must be at least 13 years of age to register an account or use BoxGames in any way. Users under 13 are not permitted to use the Platform.
  • You must be a legally resident of or physically located in a jurisdiction where use of the Platform is permitted by applicable law.
  • You may not register or use multiple accounts. Multiple accounts may be merged or deactivated at BoxGames' discretion.
  • You may not use the Platform if you are an employee, officer, director or immediate family member of BoxGames or any of its service providers.

3. Account Registration & Verification

3.1 Registration

You may create an account using your email address or mobile phone number, together with a password of your choice. You agree to provide accurate and complete information at registration and to keep it up-to-date. Each account may only be registered and used by one person.

3.2 Identity & Age Verification

Where a contact address, mobile phone number, email address or payment method is used to confirm your account or to verify a prize eligibility, BoxGames may request verification of your identity and, where relevant, your age and residence to ensure that the individual using your account is genuinely the account holder and that there has been no account takeover. In the event that BoxGames requests verification from you and you do not provide it within the time stipulated, BoxGames may suspend or deactivate your account until such time as verification has been provided satisfactorily.

BoxGames may use third-party identity-verification and SMS-authentication services to confirm your contact details and identity in order to guard against account takeover, fraudulent activity and unauthorised or dangerous use.

3.3 Account Credentials

You are solely responsible for the confidentiality of your username, password and any two-factor authentication codes. All activity performed under your account — including all game sessions, purchases, chats and communications — will be attributed to you. You must notify BoxGames immediately of any unauthorised access to your account. BoxGames will not be liable for any loss arising from your failure to keep your credentials secure.

4. Acceptable Use

You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms. You must not:

  • Use the Platform to upload, post, stream or share content that is illegal, offensive, defamatory, discriminatory, abusive, pornographic or harmful;
  • Use automated scripts, bots, macros or any software tool to interact with the Platform, harvest data from the Platform, gain an unfair advantage over other users or place other users at a material disadvantage;
  • Attempt to gain unauthorised access to the Platform, its underlying server infrastructure, or any linked third-party game servers or databases;
  • Reverse engineer, decompile or tamper with any part of the Platform, including game source code, reward algorithms or security mechanisms;
  • Sell, trade or transfer your account or any assets, rewards or achievements obtained through the Platform to another person;
  • Impersonate any other person or entity or misrepresent your affiliation with any person or entity;
  • Interfere with, disrupt or hack any game session, chat room, leaderboard or ranking system;
  • Use the Platform in any way that violates any applicable law, rule or regulation, including the Cybercrimes Act, 2020 and the Films and Publications Act, 1996.

5. Content & Community Guidelines

BoxGames promotes a safe, welcoming and inclusive community. Users are expected to:

  • Treat other users with respect, both during gameplay and in any chat or community forum offered by the Platform;
  • Refrain from toxic, harassing, abusive or exclusionary behaviour;
  • Report any behaviour that violates these guidelines by contacting support@boxgames.co.za.

BoxGames reserves the right to suspend, restrict or permanently deactivate the account of any user who violates these guidelines or whose use of the Platform, in BoxGames' sole opinion, is harmful to other users or to the integrity of the Platform.

6. In-Game Purchases & Virtual Currencies

6.1 In-Game Purchases

Some games on the Platform — clearly identified as such — may offer in-game purchases, such as games consumed by the user or virtual game-access performance services or upgrades that enhance the user's gaming experience within the online portion. In these games:

  • In-game purchases are for virtual in-game credit and virtual items only. They may not be redeemed for real-world currency, goods, services or cash.
  • All purchases are final and non-refundable, except where specifically provided for by applicable consumer-protection law, by the specific terms of the relevant game and/or user agreement, or by the BoxGames platform service agreement.
  • BoxGames does not hold payment details directly. All payments are processed by certified third-party payment service providers (PSPs).

6.2 Virtual Items & Game Currency

Virtual currencies, coins, tokens, credits and items ("Virtual Items") hold no real-world monetary value. Virtual Items may be used, consumed or disposed of within the Platform only and are governed by the terms of the specific game they belong to. BoxGames is under no obligation to compensate you in the event that Virtual Items are lost, misused, deleted or unavailable as a result of a technical fault.

7. Rewards, Incentives & Push Notifications

BoxGames may offer promotional credits, coins, bonuses or daily rewards as a non-cash incentive to encourage users to engage with the Platform for longer periods of time ("Incentive Rewards"). Incentive Rewards:

  • Are purely virtual and have no real-world monetary value;
  • Are awarded at BoxGames' sole discretion and may be withheld, reversed or cancelled where the Platform detects suspected abuse, damaged caused by use of software that may or may not have caused fraudulent activity;
  • May not be sold, transferred or redeemed for cash or any reward other than the purchase of game items within the App or Platform;
  • BoxGames reserves the right to alter, suspend or discontinue any Incentive Reward scheme at any time without notice.

Where push notifications are used to invite you back to the Platform through your mobile device browser, you may disable notifications at any time through your device settings. By enabling push notifications you agree to receive them until such time as you disable them.

Where you are invited back to the Platform through a push notification you will receive an invitation to return to the Platform with relevant rewards to encourage the user to re-engage with the Platform. Push notifications are courtesy reminders and do not constitute a guarantee of the existence of any virtual credits or rewards by the name of, or calculated in a manner similar to, the content of the push notification, which is provided as a motivator and not as a guarantee of any reward.

Where you are recognised by the Platform as being re-engaged through a push notification, the Platform may reward the user with Virtual Items or Incentive Rewards as described in this section.

8. Intellectual Property

All content on the Platform — including text, graphics, photographs, logos, video, game code, artwork, software, audio files, the design and look-and-feel of the Platform, and all trademarks and service marks — are the exclusive property of BoxGames or its licensors. No rights, licences or permissions are granted to you in or to any of the above beyond what is strictly necessary to personalise, facilitate or improve the use of the Platform for your own private, personal, non-commercial use.

If you post, upload or share any content on BoxGames you warrant that you own all rights in that content and grant BoxGames a worldwide, non-exclusive, royalty-free, irrevocable licence to use, reproduce, modify, display and distribute that content on and in connection with the Platform.

9. Electronic Communications and Transactions Act (ECTA)

By accepting these Terms and Conditions electronically and using the BoxGames Platform, you acknowledge that you have read and agree to be bound by them without the need for any physical signature, thereby constituting a valid and binding legal contract in electronic form for the purposes of ECTA.

All electronic communications from BoxGames (including account-confirmation emails, warning notices, service update communications, purchase confirmations, support responses, password resets and all in-platform notifications) are legally binding on you and will be deemed received at the earlier of: (a) the time of BoxGames' successful transmission acknowledgement to your email address or mobile number; or (b) five calendar days after transmission where no acknowledgement is generated. BoxGames will retain electronic records of all transactions in a retrievable, readable and reproducible form for the periods required by applicable legislation.

Direct electronic marketing communications will always include a simple, free "unsubscribe" mechanism in accordance with ECTA and POPI requirements.

10. POPIA & Data Privacy

Your personal information is processed by BoxGames in compliance with the Protection of Personal Information Act, 2013 (POPI). Your data-protection rights and our data-handling obligations are set out in full in our Privacy Policy, which is incorporated into and read together with these Terms. For information about your rights under POPI — including your right to access, correct, delete or object to the use of your personal information — please review the Privacy Policy. You may contact BoxGames' data-protection team at any time at boxgames@boxgames.co.za.

11. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. You irrevocably agree to submit to the jurisdiction of the appropriate South African court in respect of any dispute relating to or arising from use of the Platform or these Terms.

BoxGames customers residing outside of South Africa agree that any dispute under this contract and/or in connection with the use of the Platform shall be governed by the law of the Republic of South Africa unless such law conflicts with the applicable law of your country of residence.

12. Disclaimer & Limitation of Liability

The Platform is provided "as is" and "as available" without warranty of any kind. To the maximum extent permitted by law, BoxGames and its directors, officers, employees, agents and affiliates disclaim all warranties, whether express, implied, statutory or otherwise, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by law, BoxGames shall not be liable for any indirect, incidental, special, consequential, punitive or similar damages, including loss of profits, data or goodwill, arising out of or in connection with your use of or inability to use the Platform, even if advised of the possibility of such damages. Nothing in these Terms limits or excludes our liability for fraud, or for death or personal injury caused by negligence (where such exclusion would be unlawful).

13. Changes to These Terms

BoxGames reserves the right to change, update or replace any of these Terms at any time. We will update the "Last Updated" date visible on this page. Your continued use of the Platform following any change constitutes your acceptance of the revised Terms. We will notify returning users or existing account holders of any material change to these Terms via email or push notification.
